A tuk-tuk operator in Phuket faces criminal charges after a young British tourist and professional boxer fell from his vehicle and died from his injuries, highlighting ongoing concerns about road safety and tourist security in Thailand's popular beach destinations. Colin Cairney, aged 22, sustained fatal injuries when he fell from the tuk-tuk in the Patong area of Kathu district on Sunday, June 14, eventually succumbing to those injuries in hospital. The incident has prompted an investigation that has revealed troubling details about the driver's conduct following the accident.
Thailand's police apparatus moved swiftly to identify and question the person responsible for operating the vehicle. Pol Maj Surachat Thongyai, the investigating officer based at Patong Police Station, confirmed that authorities had brought in Kitphong, a 34-year-old native of Phatthalung province, for interrogation on Monday, June 15. Evidence gathered during the investigation conclusively established that Kitphong was indeed operating the tuk-tuk at the moment of the fatal incident. The driver rents the three-wheeled taxi from his older brother and uses it to provide transportation services to tourists and other passengers in the busy Phuket region.
According to Kitphong's account to police, the evening began routinely when he accepted a fare from two foreign tourists—a man and a woman—at Soi Bangla, one of Phuket's primary entertainment districts. His instructions were to transport them to The Nature hotel, located in the Kalim Beach area. The journey took a dramatic turn when the passengers disclosed upon arrival that they possessed insufficient cash to settle the fare, requesting instead that he drive them to an automated teller machine so they could withdraw funds. This request set in motion a chain of events that would ultimately result in tragedy.
The intoxicated male passenger proved unable to withdraw cash from three separate ATMs that Kitphong visited in the vicinity. Faced with a passenger unable to pay and growing complications, the driver made the decision to return both tourists to their original pickup location at Soi Bangla. What occurred during this return journey remains the critical question that investigators sought to clarify. The circumstances surrounding Cairney's fall from the vehicle have become the focal point of the negligence allegations now facing Kitphong.
While transiting past The Nature hotel on Phra Barami Road, Kitphong operated the vehicle at what he described as normal speed. He subsequently noticed some form of mechanical problem or irregularity affecting the tuk-tuk, yet he did not immediately halt the vehicle to investigate. Instead, he continued driving approximately two kilometres further before finally stopping to check on the problem. It was at that point that he made the discovery that neither of his passengers remained in the vehicle—the male tourist had somehow fallen out during the journey. Only later did Kitphong learn that his former passenger had sustained severe injuries from the fall and had died as a consequence.
Critically damaging to Kitphong's defence is his failure to take any immediate action upon discovering that his passenger had disappeared from the vehicle. He neither stopped to render assistance nor reported the incident to law enforcement authorities or any emergency services. This absence of proper conduct following the accident forms the basis of the more serious charges against him. Such failures represent a fundamental dereliction of duty that Thai law treats with considerable severity, particularly when death results from the negligence.
Police have pursued multiple criminal charges reflecting the gravity of the incident. The primary charge alleges negligence that directly caused another person's death, the most serious accusation Kitphong faces. Additionally, he has been charged with failing to stop the vehicle to provide assistance to an injured person and neglecting to immediately notify police or relevant authorities about the accident. These charges collectively reflect not merely the tragic outcome but also the driver's subsequent conduct, or rather his failure to act appropriately when confronted with the emergency.
During the formal inquiry stage of the investigation, Kitphong confessed to all the charges presented against him. His admissions have substantially simplified the prosecutorial process and suggest that the factual basis for the charges is robust. Thai legal authorities can now proceed to formal charges with the benefit of a documented confession, though this will not spare him from prosecution. The case now moves into the judicial phase where a court will determine both guilt and appropriate sentencing.
The tragic death of Cairney raises broader questions about passenger safety in Thailand's informal transport sector.
